SwiftFiber Terms and Conditions

Welcome to SwiftFiber. These Terms and Conditions ("Terms") govern your use of our internet, cable television, and related services ("Services"). By subscribing to or using our Services, you agree to be bound by these Terms. Please read them carefully.

2. Service Eligibility

To subscribe to our Services, you must be at least 18 years of age and legally capable of entering into binding contracts.

Services are only available in specific geographic areas where our network infrastructure is deployed. Availability at a specific address is subject to final verification by our installation technicians. We reserve the right to decline service if your location cannot be reached by our standard network equipment or if providing service would be technically or economically unfeasible.

3. Acceptable Use

You agree to use our Services only for lawful purposes. The following activities are strictly prohibited:

  • Using the service to transmit any material that violates applicable local, state, or federal laws.
  • Transmitting spam, viruses, or malicious software.
  • Attempting to gain unauthorized access to our network or other computer systems ("hacking").
  • Reselling the Service to others without express written permission from SwiftFiber.
  • Using the Service in a manner that interferes with or degrades the service for other customers.

Violation of this policy may result in immediate suspension or termination of your account.

4. Installation & Equipment

Access: You authorize SwiftFiber and its agents to enter your premises at agreed-upon times to install, maintain, or remove equipment necessary for the Services.

Equipment: Modems, routers, set-top boxes, and optical network terminals (ONTs) provided by us remain the property of SwiftFiber unless you have purchased them outright. You are responsible for preventing loss or damage to this equipment.

Return: Upon termination of service, you must return all leased equipment within 14 days. Failure to return equipment in good working condition may result in an unreturned equipment fee.

5. Billing & Payments

Charges: You agree to pay all charges associated with the Services, including monthly service fees, installation fees, equipment rental fees, and applicable taxes and surcharges.

Billing Cycle: Services are billed in advance on a monthly basis. Payment is due by the date indicated on your invoice.

Late Fees: A late fee may be applied to accounts with past-due balances. We reserve the right to suspend or terminate service for non-payment after providing notice as required by law.

6. Service Reliability

SwiftFiber strives to provide continuous, high-quality service. However, we do not guarantee that the Service will be uninterrupted or error-free.

Speeds advertised are "up to" speeds and may vary based on factors such as network congestion, distance from our central office, the condition of wiring inside your home, and the capabilities of your personal devices.

We are not liable for service interruptions caused by force majeure events, including but not limited to storms, fires, floods, or other acts of nature.

7. Cancellation & Termination

By Customer: You may cancel your service at any time by calling our customer service department. If you are under a term contract, an Early Termination Fee (ETF) may apply.

By Company: We may terminate your service immediately if you violate these Terms, specifically the Acceptable Use Policy, or fail to pay valid charges.

Refunds for prepaid services upon cancellation will be prorated based on the number of days service was provided in the final billing cycle, subject to state law.

8. Privacy Protection

We value your privacy. Our collection, use, and disclosure of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Limitation of Liability

To the maximum extent permitted by law, SwiftFiber shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the Services.

Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you for the Services during the three (3) months prior to the event giving rise to the claim.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website, sending you an email, or including a notice on your bill.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms.

11. Governing Law

These Terms and any disputes arising out of or related to the Services shall be governed by and construed in accordance with the laws of the state in which the Service is provided, without regard to its conflict of laws principles.
